You're so right, Sean. There's no real difference.
And yet the president didn't do anything to get rid of miscegenation bans. It was the Supreme Court (after most states had already done it themselves). And I'm guessing Scalia would be able to come up with a reason it's totally different, and more than a few of his colleagues will agree.
