Man kills 17-month-old boy for acting like a girl

This seems less like an attempt to kill the child and more like excessive violence that ended up killing someone, gender policing gone too far. And now a kid is dead. Transcript at the local news site.

Ug. This is just terrible: first of all, how can a 17-month year old "act" like a girl. He's just a baby, so gendered prescriptions should not apply. This murder is a great -- well, powerful -- example of how heteronormative society can lead to disastrous conclusions. Parents should be given cultural competency lessons, by law, to deal with queer kids, or just to understand that gender identity is not necessarily a "one size fits all" kind of deal.

You don't need a class to know not to punch a baby - repeatedly. For any damn reason.

No - that's murder. Not manslaughter.
Its never ok to strike a child....hell, punch a child?
"never hurt it before"?
"one mistake and I'll pay 20 years of my life"??
....I'm part Native American, there are so few of us...Killing this child ...

As a person who's gender variant and Transgender and who was abused growing up for being different... give me 30 seconds alone with him. I feel the need to vent.

Harming a toddler? Scum. Killing one? Unfathomable. And for that motive? I prefer a death penalty where the execution fits the crime, and I understand that's a bit of an extreme point of view, but I think it's far. He ought to be beaten to death and his neck snapped.

I, too, am part Native (Cherokee), as well as transgender. We will never know if this child could have been gender variant; maybe so, maybe not, at that age only (s)he could tell. That doesn't justify even mild punishment. Look into the face of our enemy.

I pray to the gods of justice and death that this man is shown NO mercy here or beyond this mortal plane.

"one mistake and I'll pay 20 years of my life" grabbing a baby and punching it to death is not making a mistake nor should it be a twenty year prison sentence.He should be hung by his balls and shot in the head.

Then, after pretty much admitting he hit the kid like that, he has the balls to plea "not guilty". He cant even man up to what he did. I guess little magic fairies did it for him or something.

I hate to sound pre-judgmental, but there are times when you just have to take responsibility for your actions. This is one of them. Someone died because of this dweller at the shallow end of the gene pool.

Strikes me as a minor variation on the standard domestic abuser's excuse: "The victim made me do it! If only the victim didn't do that one outrageous thing that triggered my rage, there would be no problem."

The possibility of a bizarre form of trans panic may be corroborated at some point, but the bottom line will remain that this guy had the propensity to kill a toddler in his care and the audacity to defend it as justifiable.

Unfortunately, there are meny straight heterosupramacists out there who either psychologically or physically beat children because of their gender or orientation. As one can see sometimes to death. This is what must motivate us to get ENDA, DADT and DOMA repeal should be about, our children's future and the future of a more peaceful America. We don't need the religious haters to keep telling people how to live and damaging the psyche of American children. This deep misogeny is the product of Abrahamic religious upbringing, no doubt about it.

As a WiccanI could not advocate the death penalty for him. However, I could not tolerate him ever returning to the public domain. I have a suggestion that creative means be used to deal with this abomination of human life.
Place him for the rest of his natural life in a mens prison, but with the surgical gender transtion done to him. As some far point in time he will begin to comprhehend that which he has done. Think about it...

He'll be almighty popular in prison. Baby killers always are.

Why is this manslaughter? He beat a baby to death? Is the beating of a possibly transgender infant somehow partially justified?

The line usually isn't "justifiability." It's most likely because the prosecution doesn't think they can prove intent to kill.

Doesn't that depend on other factors as well? I someone holds a small caliber weapon to another s head but thought it was too small to kill - that it would just knock him out - wouldn't that be 2nd degree murder in many places?

And isn't felony murder when someone dies during the commission of a felony applicable? The level and type of assault and child abuse does seem to be a felony. If someone can be charged with murder if they're robbing a bank and someone get's startled and falls down the stairs; it seems the charge could apply here.
